Premise and Effectiveness of the General Conditions<\/strong><\/h2>

These general terms and conditions of sale (hereinafter, the \u201cGeneral Conditions\u201d) govern the purchase of products and services carried out remotely and made available via the internet through the website www.masseriascianne.it <\/span> (hereinafter, the \u201cSite\u201d), in compliance with Italian legislation pursuant to Legislative Decree 206\/2005 and subsequent amendments and additions (hereinafter, the \u201cConsumer Code\u201d).<\/p>

The seller of the products: AZIENDA AGRICOLA SCIANNE di Barba Flaviana, Prov.le <\/span> 114, km7 \u2013 73048 Nard\u00f2 \u2013 VAT No. 02076350756 \u2013 Certified Email (PEC): barbaflaviana@pec.it<\/strong><\/p>

The consumer who accesses the Site to make purchases (hereinafter, the \u201cCustomer\u201d) is required, before submitting the order, to carefully read these General Conditions, which have been made available on the Site and may be consulted at any time by the Customer, including through the link contained in the confirmation email of each order, allowing them to reproduce and store them.<\/p>

If the person making purchases on the Site requests the issuance of an invoice and\/or is not a \u201cconsumer or user\u201d as defined in Art. 3, paragraph 1, letter a) of the Consumer Code, the withdrawal rules set out in Articles 7 and 8 of these General Conditions shall not apply, nor, more generally, the provisions of the Consumer Code that apply exclusively to \u201cconsumers\u201d.<\/p>

Contracts concluded with Azienda Agricola Scianne through the Site are governed by these General Conditions in compliance with Italian law. The language available for concluding the contract is Italian.<\/p>

Choosing and Ordering Products<\/strong><\/h2>

The features and prices of the various products for sale on the Site (hereinafter \u201cProduct\u201d or \u201cProducts\u201d) are shown on the page relating to each Product.<\/p>

To purchase the Products, the Customer must fill in and submit the electronic order form, following the instructions provided on the Site. The Customer must add the Product to the \u201cCart\u201d and, after reviewing the General Conditions and the Privacy Policy and confirming acceptance, enter the shipping and any billing information, select the desired payment method, and confirm the order.<\/p>

By submitting the order from the Site, which constitutes a contractual offer, the Customer acknowledges and declares that they have read all the information provided during the purchase procedure and fully accept these General Conditions and the payment terms.<\/p>

The contract between Az. Agricola Scianne and the Customer is considered concluded upon acceptance of the order by Az. Agricola Scianne. This acceptance is communicated to the Customer via an order confirmation email containing a link to these General Conditions, the order number, shipping and billing details, the list of Products ordered with their essential features, and the total price including delivery costs.<\/p>

Product Information<\/strong><\/h2>

Information and features relating to the Products are available on the Site.<\/p>

The visual representation of the Products on the Site, where available, usually corresponds to the photographic image accompanying the product description. It is understood that the image has the sole purpose of presenting the Product for sale and may not perfectly represent its characteristics and qualities, possibly differing in color or size. In case of discrepancies between the image and the written product description, the written description shall prevail.<\/p>

Prices and Shipping<\/strong><\/h2>

Product prices include all taxes and duties. All prices are expressed in Euros.<\/p>

Shipping within Italy:<\/strong> Azienda Agricola Scianne ships conveniently throughout Italy. Delivery is free for orders over \u20ac150.00, while for lower amounts the cost is \u20ac15 (2\u201320 kg), \u20ac20 (20\u201330 kg), \u20ac30 (30\u201350 kg), \u20ac40 (over 50 kg), excluding islands. It is also possible to pick up the package in person for free at Agriturismo Masseria Scianne, Prov.le <\/span> 114, km.7, 73048 Nard\u00f2.<\/p>

Payment Methods and Invoicing<\/strong><\/h2>

5.1 Payment Methods<\/strong><\/h3>

The Customer may pay for the Products and related delivery costs by credit card via SumUp payment link or by bank transfer. The payment circuits available via payment link are:<\/p>

  • Visa \/ Visa Electron<\/p><\/li>

  • Mastercard<\/p><\/li>

  • Maestro<\/p><\/li>

  • American Express<\/p><\/li>

  • Google Pay<\/p><\/li>

  • Discover<\/p><\/li>

  • Diners Club<\/p><\/li><\/ul>

    To ensure maximum security, the Customer will carry out the payment transaction directly on PayPal\u2019s server.<\/p>

    The Site does not store the Customer\u2019s credit card number, but thanks to the secure communication system of the relevant financial institution, from the second purchase the Customer may\u2014by selecting the appropriate option\u2014proceed without re-entering their data. The financial institution uses the SSL protocol to encrypt data transmitted between its server and the Customer\u2019s browser.<\/p>

    Bank Transfer<\/strong><\/h2>

    The Customer must make the bank transfer within 3 days from the order date for orders relating to products; bank transfer is not available for orders containing events and\/or courses. If payment is not received within 3 days, the order will be cancelled and the goods made available again for purchase by other Customers. The Customer who has not completed the transfer may be contacted by Customer Service to clarify whether the missing payment is due to the Customer\u2019s intention not to confirm the purchase or other reasons.<\/p>

    Bank Transfer Details<\/strong><\/h2>

    5.2 Order Invoicing<\/strong><\/h2>

    If the purchase is made by a professional, it is possible to request an invoice by selecting the appropriate checkbox during the order process and entering the billing information, including tax code and\/or VAT number. In this case, the invoice will be sent via email to the address provided. The professional is responsible for correctly entering the billing information and is expressly informed that, if the invoice is not requested during the order process, it will not be possible to request it afterwards.<\/p>

    Transport and Delivery<\/strong><\/h2>

    The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase process in the \u201cShipping Details\u201d field.<\/p>

    All purchases will be delivered by express courier (hereinafter, the \u201cCourier\u201d) from Monday to Friday, excluding public holidays and national holidays. Azienda Agricola Scianne is not responsible for delays that are unforeseeable or not attributable to it.<\/p>

    Once the Products have been shipped, the Customer will receive a confirmation email.<\/p>

    In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within 7 (seven) working days from the day following the order confirmation email sent by Azienda Agricola Scianne, except during Christmas and Easter holiday periods, when this timeframe cannot be guaranteed.<\/p>

    Right of Withdrawal<\/strong><\/h2>

    The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. The right of withdrawal is valid within 14 days from the date of receipt of the goods; however, in accordance with current Italian law, the right of withdrawal may only be exercised for products that can be resold without risks to consumer health. For this reason, it is not possible to return food products (including alcoholic beverages), as adequate storage conditions cannot be guaranteed.<\/p>

    It is also not possible to return: \u2013 products made to measure or clearly personalized; \u2013 orders for which an invoice has been issued.<\/p>

    For the withdrawal of non-food items, return shipping costs are borne by the customer and amount to \u20ac15.<\/p>

    Warranty and Lack of Conformity<\/strong><\/h2>

    In the event of a lack of conformity of Products sold by Azienda Agricola Scianne, the Customer must immediately contact Customer Service by writing to info@masseriascianne.it<\/strong>.<\/p>

    The legal warranties provided for in Articles 129, 130, and 132 of the Consumer Code apply to the sale of Products. The Customer has the right, at their choice and provided the type of Product allows it, to restore conformity of the Product free of charge through repair or replacement, or to an appropriate price reduction or termination of the contract. The Customer loses these rights if they do not report the lack of conformity to Azienda Agricola Scianne within two months from the date on which the defect was discovered, unless the Product is by nature perishable or subject to expiry within a shorter period, in which case the defect must be reported within that reduced period.<\/p>

    Errors and Limitations of Liability<\/strong><\/h2>

    The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors, for which Azienda Agricola Scianne cannot be held responsible, except in cases of fraud or gross negligence.<\/p>

    Azienda Agricola Scianne reserves the right to correct errors, inaccuracies, or omissions even after an order has been submitted, or to modify or update information at any time without prior notice, without prejudice to the Customer\u2019s rights under these General Conditions and the Consumer Code.<\/p>

    Except in cases of fraud or gross negligence, any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and\/or property caused by the non-acceptance or partial processing of an order.<\/p>

    Azienda Agricola Scianne promotes the responsible consumption of alcoholic beverages and excludes any liability, except in cases of fraud or gross negligence, in the event of purchases made by individuals under 16 years of age. By purchasing any alcoholic product, you declare that you are of legal age as required by Art. 7 of Legislative Decree 158\/2012. Azienda Agricola Scianne assumes no responsibility in the event of purchases made by individuals under 18 years of age who have declared a different age.<\/p>

    Complaints<\/strong><\/h2>

    Any complaints must be sent to info@masseriascianne.it<\/strong>. Azienda Agricola Scianne undertakes to respond to all requests received within a maximum of 7 working days.<\/p>
